We are pleased to announce that the Court of Appeals for the Fourth Circuit has just ruled that Maryland's Handgun Qualification License requirement is unconstitutional under the Second Amendment.

General Assembly alert! House Bill 387 imposes a new 11% EXCISE TAX on gross receipts of firearm retail sales made by Maryland FFLs and on retail sales of firearms made by a selected group of out-of-state FFLs. That 11% excise tax is on top of the existing 6% Maryland Sales Tax for a total tax of 17% on all sales of firearms. Another Bill, HB 937, takes a different track. Instead of imposing an excise tax, HB 937 just doubles the sales and use tax, increasing that tax from 6% to 12% on all sales of firearms, ammunition, and firearm accessories. Newly taxed accessories include magazines, stocks, body armor and scopes and other optics. Both Bills are unconstitutional as both are aimed at taxing the exercise of a constitutional right. Indeed, if enacted, the bills will likely force Maryland dealers out of business as Maryland dealers will be unable to compete with out-of-state dealers. Both bills are scheduled to be heard by the House Ways and Means Committee at 1:00pm on February 13, 2025.

Today we filed a petition for certiorari to the Supreme Court of Maryland, seeking review of the lower appellate court decision in our suit against Montgomery County. The case is Engage Armament v. Montgomery Co., MD. You can find the Petition here. The Supreme Court of Maryland, of course, has discretion on whether to grant the Petition. When it will act is entirely up to the Court.

On December 16, 2024, the State filed its Brief in Opposition to our Petition for Certiorari filed with the Supreme Court in the HQL case in which MSI and individual plaintiffs (including Atlantic Guns in Rockville) have challenged the constitutionality of Maryland Handgun Qualification License requirement. We will file a reply in response to State's filing and the case will thereafter go to conference at the Supreme Court sometime in mid to late January over whether to grant the petition for certiorari and hear the case on the merits. We and the other plaintiffs (including the individual and the other organization plaintiffs) have just filed our opening brief with the Court of Appeals for the Fourth Circuit in our challenge to SB1, the legislation that imposed new and and unconstitutional restrictions on carry by permit holders in Maryland. The State has 30 days to file a responsive brief, after which we will file a response to that brief. Stay tuned.

The Fourth Circuit today rejected our constitutional challenge to Maryland's Handgun Qualification License requirement, holding that the law did not even infringe on the Second Amendment right to keep and bear arms. We believe that holding is contrary to controlling Supreme Court precedent and is plainly wrong as a matter of common sense. The majority opinion is, in the words of the dissent, "baseless." The petition for certiorari to the Supreme Court practically writes itself.
