I'm a pilot and listened to the audio several times and can fairly say most of the fault will lay with the blackhawk pilot and some with the tower for allowing traffic to get that close to each other despite collision warnings are their radar. The innocent victim of this disaster is the CRJ as once he was cleared to land, he is essentially being assured by the tower that all the space around/between he and the landing zone is clear of all traffic.

Most fault is with Blackhawk pilot. Tower asked way before the accident if the Blackhawk pilot had the jet in sight and they responded with yes and state they would maintain visual separation. The tower had no reason to doubt the pilot. These types of replies happen thousands of times daily with no incidence.
