I wanted to repost this because I genuinely enjoyed having conversation with @evanhowington . As the news and reaction to it becomes more divisive, I think we should all remember genuine productive dialogue, without disrespecting people is what makes us all better.

So the interesting exception to the rule is that they’re allowed to go higher to avoid collision. It’s possible when ATC requested the helicopter get visual separation the helicopter crew misidentified what plane ATC was talking about. Also, the near misses, at least at Reagan, come from the fact that it’s an incredibly crowded airspace. The runway the American Eagle jet was directed to land on is for smaller jets like theirs, and requires the jet to be at lower altitude on approach because it’s shorter. That can create a recipe for disaster if someone misinterprets what ATC tells them to do. Again, all speculation until the NTSB released their full report.

It’s true we will never know what happened inside of the cockpit. However, the facts we have now are that the helicopter was above the 200 foot elevation limit, and that air traffic control told the helicopter to wait until the jet had passed. It would not have been on the jet to notice the helicopter. Helicopter would have also needed prior approval to fly above the 200 foot limit. Of course this is just speculation at this point based on the facts we have the full NTSB report will shed more light on it.
