Those damages have various sources of recovery. One of them is Mr. Kahn. One of them may be the estate. One of them may be B. Riley for its role in working with Mr. Kahn. And one of them may be Willkie. And B. Riley and Willkie may have aided and abetted Mr. Kahn in what turns out, or what the government seems to imply, is a fraudulent enterprise. So, my concern is that you’ve got these four parties on a railroad track and a train is coming and you have this perverse incentive to see that the other three get hit first.”   An attorney for Prophecy recently highlighted the role of B. Riley in this apparent fraud:   “Since 2018, through concurrent representations, Willkie has been privy to the interconnected wild ride of both Brian Kahn and his Vintage companies, and FRG, as well as both of their collapses. Often times, representing one. Often times, the other. And in other times, both or even more in the same transaction. And that even more, by the way, is B. Riley – it shouldn’t be lost on anybody here that Bryant Riley was a director, he is on the Board of FRG. He is all over this transaction and that is a third element that we did not get many disclosures on. The transactions that Willkie had its hands in, all while contemporaneously representing FRG, B. Riley, and Kahn are plentiful. … Acquisitions that happened throughout the same time period that Brian Kahn was having his issues with Prophecy Trust. At the same time, while all of this was going on, Willkie’s client, B. Riley, had lent $100s of millions to Brian Kahn.   I agree with Mr. Shore, it is not going to get prettier.There is going to be litigation and the litigation is going to be involving parties that were represented, all of them, by Willkie.”   Sworn testimony now also has established that Bryant Riley personally negotiated more loans to Kahn, even after he was named in the indictment and had no means to pay them back".
