They're involved in a topic of public interest/controversy & have appeared on national TV. This changes things in the legal context of protected speech

Those hashtags didn't send KP a notification...they didn't send her a phone call or an email...KP sought them out

Maybe he misunderstood what a hashtag is and how they work, but hashtags don't contact anyone, & in fact Katie had to seek them out in order to be bothered by them.
