In disclaiming Project 2025, Trump says 1) he doesn't know what's in it, and 2) it's too extreme for him. So which is it? If he thinks it's too extreme, that suggests he DOES know what's in it. And if he doesn't know, how can he say it's too extreme?

My take on today's Michigan Supreme Court ruling concluding govt cannot seize entire value of house to pay $8.41 in delinquent property taxes. Such seizure is taking requiring compensation under state constitution. A big win for @PacificLegal !

The ridiculous controversy over @KamalaHarris 's eligibility for VP/presidency - like that over Ted Cruz in 2016 - strengthens already compelling case for abolishing the "natural born citizen" requirement entirely.

Deeply saddened to learn the great David Boaz may not be with us much longer. Liberty has few better or more principled defenders.

Selection of Vance as Trump VP nominee further cements nationalism as dominant ideology in GOP. In our National Affairs article, "The Case Against Nationalism," @AlexNowrasteh and I explained why nationalism is extremely harmful and pernicious:

"U.S. intensifies push to use Moscow’s $300 billion war chest for Kyiv.'" Yes, definitely do this. Seize all Russian state assets in the West, and use them to fund military assistance to Ukraine, plus compensation for victims of Russian war crimes.

@EricaGrieder 9-0 in rejecting Texas' substantive claims. 7-2 on the technical issue of whether that can be done by denying Texas leave to file a complaint (Alito and Thomas would have let them file, but then ruled against them).

My new @lawfare article on why Texas is wrong to equate illegal migration/drug smuggling with "invasion." Claim goes against text/original meaning, and would set dangerous precedent for war powers & civil liberties.

The Nixon pardon was a mistake. Punishing criminal abuses of power by people in high office is actually even more important than punishing similar crimes by underlings.

President Ford's press secretary Jerald terHorst wrote him to quit his job in protest after Ford pardoned Nixon fifty years ago today: "It is impossible to conclude that the former President is more deserving of mercy than persons of lesser station in life."

My take on Biden's new vaccination mandate policies. Some are both laudable and (most likely) legal. But broad mandate on private employers is legally dubious and would set a dangerous precedent if upheld by courts. I support goal here, but not means.

My take on yesterday's important New Jersey court decision ruling that government can't use eminent domain to seize property to indefinitely "bank" it for some unspecified future purpose. Congrats to @IJ on this victory!

Trump's threat to use "the military version of eminent domain" to take land for his border wall is just part of a broader pattern of administration policies that threaten property rights.

Some GOP leaders argue against impeachment on grounds that it will exacerbate national disunity. In this post, I propose a simple way for them to fix that problem: They can support impeachment themselves.

Vivek Ramaswamy's idea of a "libertarian-nationalist alliance" makes as much sense as a libertarian-socialist alliance. Nationalism is totally inimical to liberty. See my article w/ @AlexNowrasteh on that subject:

Xi Jinping hates being depicted as Winnie the Pooh. But in truth this comparison is an insult to Winnie - who, unlike Xi, hasn’t committed massive atrocities and human rights violations.

Current law requires asylum-seeking migrants wait at least 6 months to get work authorization. This hurts both migrants and US economy. Dropping this restriction should be a no-brainer.
