Man City fan who waited a year for trial wins case when sole prosecution witness, a police officer, failed to attend court. A successful outcome but fan deprived of opportunity to challenge officer’s actions and account, cctv supporting defence.
Fan leaves court with no ban, having been told before receiving our legal advice and representation, that he'd be getting a 'mandatory ban' - low level, fine only offence. Not too difficult to work out who gave the incorrect info.....
Two fans (different cases) avoid bans for fine only offences. Both had no previous history with police or club. Made one silly mistake. Court agreed with lawyer’s submissions. One had lawyer at magistrates, other had lawyer on appeal. Lawyers make a difference.

Congratulations to fan found not guilty at trial despite prosecutor calling a senior police officer to give evidence. Law was always on our side but prosecution continued (in the hope of a FBO?)

Not all fans are arrested if suspected of an offence, we frequently advise fans invited down the station for a ‘chat’ only to find there’s no tea&biscuits and feels more like a one way ticket to court. Even if at the station, stop, ask for a solicitor.

Fan acquitted of public order offence after trial and in a separate case, charge of public order discontinued. Both fans pleaded not guilty after legal advice and representation.
If you are stopped at the airport or ferry port by police and served with section 21B form to attend the magistrates court within 24 hours you can request an adjournment at court to obtain specialist legal advice to consider merits of contesting FBO application.

Football narrative is far more negative, it’s helped create the view that football cases are ‘hooligan’ cases, racing fan description is balanced it’s just not applied to football fans.
Police simply confirm 3 people arrested on suspicion of affray.
Nothing to say these people aren’t genuine race goers or that they’ll be dealt with robustly through the courts, or that racing is a family sport & there’s no place for disorder
Further stats from 2022: FBO early termination applications: 100% success rate.
Opposing CPS/police appeals against magistrates’ refusal to impose FBO: 100% success rate (100% against every one in the last 12 years).
Not a guarantee on future performance but doing ok so far…

Reminder of how important it is to oppose FBO applications made on basis travelling to/from a football match. Offence is NOT “football related” just because you’re travelling to/from a match, offence itself must relate to football.

Good example of the difference representation can make: fan charged with section 5 public order pleads guilty, conditional discharge and no ban. Would normally be a fine for this offence so representation has paid for itself.
Fan charged with violent disorder found not guilty at trial. Legal issue arises frequently, presence within group where some are violent (or threatening violence) & you are “looking” (not encouraging) your presence can result in arrest/charge as “lending weight to the crowd”

1,542 arrests in season 17/18 of which 460 fans received banning orders at court i.e. less than a third of those arrested receive bans. Yet we see application requests for bans in almost every prosecution.
Fans call up almost apologising for taking up time asking do they really need representation at voluntary interview? Shocked when told, interview under caution, interview may be heard by court/jury if prosecuted&trial, imprisonable offence etc... yes it’s worth our time!

Reminding fans of their right to free legal representation (particularly for offences which can result in prison sentences)does not equate to condoning offences, neither does it promote evading justice (“getting off”) your interpretation of the “message” is way off.
Currently possession of drugs at football does not allow for a FBO application at court. If it’s 1st offence, fans should get a caution (as they would if not football related) we’ve represented a number of fans charged, and had cases reviewed resulting in a caution instead.
Not all fans are arrested if suspected of an offence. If you’re asked by police to give contact details and they’ve been in touch & ask you to attend station to discuss/chat about an incident/your behaviour please get legal advice (100%free) before attending
