@MaxAbrahms
You're defending voting for a rapist fraudster who tried to overturn an election and who was convicted on 34 felony counts, who played golf 300 days and overbilled the taxpayers, and who valued Russia over American intelligence.
Maybe politics isn't for you.
@yashar
odd how CNN keeps featuring stories about supposed Biden deficiencies, but we can't get them to question Trump's lies the numerous times they have him on their network
Understand that Knight Specialty has a problem. This bond cannot be approved. Under the CPLR, the surety will remain obligated under the bond until a replacement bond is filed. Trump is unlikely to get a replacement bond. Knight Spec will be liable AND Trump won't have a stay.
Apparently knowing that they have a problem, they also include the fin statement of Knight Insurance. Not only is it still laughable, but Knight Ins is not a surety on the bond. It doesn't have any obligation to pay if a demand is made.
@MaxAbrahms
people don't care that a guy is a rapist or that he is in the pocket of our enemies or that he bilked the government or that his failure to address covid led to the death of a million Americans because of "leftwing extremism" -- if you're insane
Here's the deal with the bond. Don't listen to the WSJ. Their article is wrong. An insurance company has to be qualified to write a bond in NY. CPLR article 25 and Insurance Law article 11.
There still is no compelling reason for Justice Engoron to allow this bond to stay collection. It is written by a company not authorized to write bonds in the State, appears to be the only bond it's ever written, and is not adequately capitalized by either the insurer or Trump.
This surety cannot be justified. They're not authorized. They cannot justify the bond without getting State approval. So this is just a huge time waster for Trump. A huge delay tactic. The AG can't do anything until the Court rejects the bond.
@lawofruby
I bet they are going to claim that the bond is a "surplus line" and they don't need to be authorized. That's wrong. Surety bonds are not a surplus line.
I do surety bonds for a living. This bond is of dubious validity.
@TishJames
should get on this.
I have a correction -- I've said that the collateral is irrelevant. That's wrong. There's a provision of the Insurance Law that allows a surety to write a bond irrespective of its own capital if it obtains collateral for the amount above what it is authorized to write.
@KatiePhang
And now we'll see that the debate doesn't matter. Judge Chutkan will hold a hearing on what's official/unofficial, and all of the testimony and proof about what Trump did and didn't do in connection with the Jan 6th will sway the electorate back to Biden.
If I recall correctly, there was an article reporting statements by the head of Knight that raised questions about whether Trump collateralized the bond and, if so, what that collateral is and whether its value is credible.
@DonnaofBoston
@lawofruby
A bond has to have a power of attorney and financial statement when filed to be valid. This bond has neither. But they can fix that and refile. This insurance company is not authorized to write surety bonds in NY. If the AG contests the bond, the Court has to reject it.
The amount also can be considered if the insurer has applicable reinsurance (which I doubt Knight Specialty has since it doesn't appear to really be in the surety business).
@UrbanistaRamon
@lawofruby
Not only is the bond "without effect" if they fail to file for justification, but Knight remains liable under the bond nonetheless until a replacement bond is filed.
@anonymous75248
@lawofruby
there's no deadline for him to fix this defect with the bond, but while there's no bond, there's no stay preventing the AG from taking steps to collect the judgment
@JamesSurowiecki
Because it relates to whether he is or is not being honest with the public about the extent of his injury? As we used to expect of all of our candidates for president but now make an exception for one of them?
@johnastoehr
for a week, everyone said "when you go to sleep, Trump may have a lead, but that will change when they count the mail in ballots over the next days"
and that seems to be exactly what's happening, yet everyone is freaking out
@lawofruby
Here's another issue. The 1st Dept's order says that execution is stayed upon Trump posting a $175 million bond within 10 days. He failed to do so. If I was the AG, I'd take the position that he blew his opportunity to post a $175 million bond. Let him make another motion.
The AG has to object to the bond (known as "excepting"). The bond lacks the required supporting documents and was written by an unauthorized company. Trump then gets 10 days to move to "justify" the surety.
@greta
There was a really credible, intelligent woman on CNN at one time also named Greta Van Susteren, if I remember correctly. I wonder what ever happened to her.
@onlyonecomment
I told someone else -- surety is a niche practice and I always dreamed one day we'd have our day in the sun. Never really thought it would happen though.
@joelockhart
I have no idea what your tweet means, but everyone from Jones Day involved in this effort should be disbarred. They're an affront to the legal profession. Clients who care about our country should pull their work.
@johnastoehr
If my career in media was like Jake Tapper's and I was hosting a deabte where 1 candidate was lying everytime he spoke, and the format was not conducive to challenging his lies, I'd change the format on the spot and not allow the liar to use my network and me to lie to America.
@RadioFreeTom
Gas will be a lot lower under Trump too thanks to his brilliant plan of letting a fatal contagious virus run rampant in the country so demand for fuel goes way down. This William Welch is on to some things.
@kylegriffin1
he can't because (1) it's largely leveraged, and (2) surety companies are not going to give him credit knowing that he'll fight repaying them when he loses.
@EricLisann
I know they don't do surety law for a living but surety bonds are not foreign to the office. The first thing that should have hit them is "who the hell is Knight Specialty Insurance Co"? They're not approved to write surety in the State.
@NPRinskeep
@DanaBashCNN
@jaketapper
not only is this opinion ridiculous, but an actual moderator from Colorado showed how to actually moderate a debate a few short weeks ago, and was widely praised for doing so
@OlgaNYC1211
what's unbelievable is that, knowing what we know about Russians buying politicians and media in other countries, she hasn't been indicted
Please don't get caught up in this Pro Publica story that Trump lied to the court about not being able to get a $460mm bond. How was Knight going to back it when they don't have the assets for a $175mm bond? That's like the local crazy guy offering Trump a $460mm bond.
@eclecticbrotha
the "pro-Palestine" protesters who were protesting Israeli "atrocities" in response to the October 7 attack before Israel had set a single foot in Gaza in response? Those protesters?
@baseballcrank
... he said unironically, ignoring that the raping, fraudster candidate who tried to overturn an election who he'd prefer to see in the White House is a mere three years younger than the "weak octogenarian"
@frozengoat08
@EricLisann
Knight Specialty is not T-listed and they are not approved to write surety in New York. This is a screenshot of a search of "Knight" on the NYS DFS website. I've been doing surety in NY for 30 years. I've never heard of them or seen a bond of theirs.
The Times is reporting that Justice Engoron has scheduled a hearing for the 22nd "to discuss the bond". I don't understand what he's doing. Trump or Knight have to move to justify the bond. They have the burden of proof. There should not be a hearing until they make a motion.
Ginny Thomas working on a coup and being married to a Supreme Court justice, however, is a non-issue.
These are not serious people, and certainly not "patriots".
@58isthenew40
@kaitlancollins
A surplus line insurer does not need to be authorized to transact surplus line business but surety bonds are not surplus lines. They're surety bonds.
@eorden
Erica -- it does not appear that the bond is valid. Knight Specialty Ins Co does not appear to be authorized to write this bond in New York. I'm in the industry.
@ndrew_lawrence
I'm sure the truckloads of money that Trump supporters Vince and/or Linda McMahon are having dumped on the Wreck ... er the Rock's driveway didn't have anything to do with this heel turn
@58isthenew40
@kaitlancollins
I don't believe they're authorized to transact business as a surety in New York. They don't appear to be T-listed either. I do surety work in New York State. I've never heard of them.
The AG's brief is good but I think there's one point that it fails to make properly. CPLR 2502 says that, unless the court orders otherwise, a surety must be either "an insurance company authorized to execute the undertaking within the state" or a "natural person".
BREAKING: NY AG slams Trump's shady $175 million bond in new hard-hitting brief arguing that the Knight bond should be rejected
Knight does NOT have the assets to cover the bond -- and uses a Cayman Islands company to provide "shadow insurance" to fake its financial capacity
@porter_mar64166
@eorden
The AG should take the position that the bond is not valid and start executing. She also could move to strike the bond first. I bet this is a delay tactic by Trump. He knows she won't just execute. So she'll move to strike and he'll get more time to find a real bond.
@lawofruby
@TishJames
I regret to say this because I know Cliff Robert to be a good guy. But he e-filed that bond. He's gonna be responsible for filing a bond that's not valid. He's gonna bear the brunt of the Court's displeasure.
@bobcesca_go
A bond must be accompanied by a financial statement and a power of attorney when filed to be valid. The bigger issue is that this company is not authorized to write surety bonds in NY. The AG needs to contest the bond. The Court must reject the bond if she contests it.
Who would have a guessed that the country that led the prosecution of the Nazis, which rejected the defense of "just following orders", would have a constitution that prevents the person who gave those orders from being prosecuted.
#immunitydecision
@SethDavisHoops
These formulations are ridiculous. It's not about who got left out. It's about who got left out compared to who got in. Virginia over any one of five teams left out is indefensible.
While we were lighting our hair on fire warning about the dangers of a Trump presidency, for moments exactly like this one, people on 'the left' like Walker Bragman were pushing a Liberal Case for Donald Trump & arguing that a Hillary president would actually be worse.
@frozengoat08
@EricLisann
The "specialty" in the name is a giveaway that its business includes surplus lines. I bet that's what they'll use as justification, to try to avoid penalties for writing a bond without authorization. It's nothing more than a delay tactic, Trump manipulating the judicial system.
@nypost
wow big scoop ... what a "comedian" thinks about an editorial -- maybe you can follow up and find out what Jimmy JJ Walker and Carrot Top think about the editorial too
@File411
They can write "surplus lines insurance" without authorization. But surety is not a surplus line. I believe it's a delay tactic. They know the bond isn't valid but the AG won't execute without moving to strike the bond first. And Trump gets more time.
@joe_kidder2
@MiamiBe44167721
@alxindia
My understanding is that Judge Jones is merely watching the use of assets for collateral, to secure a bond. Not the actual bonding itself.
@porter_mar64166
@eorden
The AG should take the position that the bond is not valid and start executing. She also could move to strike the bond first. I bet this is a delay tactic by Trump. He knows she won't just execute. So she'll move to strike and he'll get more time to find a real bond.
@capitolhunters
I'm not sure how the response isn't simply "Don-old Trump bought his way out of serving his country and called servicemen suckers and losers bye now".
@Stepman19
@58isthenew40
@lawofruby
I don't know if she has realized it yet at all. The Clerk rejected the bond because it was not complete. The Clerk can't reject the bond because of who the surety is. The procedure is that the AG has to serve an "exception" to the bond upon Trump.
@marthamallory1
@lawofruby
I have serious questions about whether a "surety" that is not authorized to do business in NY, that doesn't do any other business in NY, that doesn't have assets in NY, and that is close to Trump would pay the bond and not make the AG chase them in California to collect.
@matthewhaag
the statement that Knight "should be able" to tap into Trump's collateral is not correct and really should come out of the article. I don't know why you guys would say that as if it's relevant to whether the bond is valid.
@baseballcrank
Harris is the "systematic enemy of the Constitution". Right.
Serious question: how are you not in an institution? You're approaching Jeffrey Dahmer and Laura Loomer levels of lunacy.
@lawofruby
@TishJames
I regret to say this because I know Cliff Robert to be a good guy. But he e-filed that bond. He's gonna be responsible for filing a bond that's not valid. He's gonna bear the brunt of the Court's displeasure.
@academic_la
yeah I quit following that account pretty quickly ... I have doubts that it's legitimate, but even if it is, the idea that the "bad Jews" are the ones who aren't voting for the guy who's loved by the Nazis is bafflingly comical.
@QasimRashid
With what crimes should the marching Charlottesville Nazis been charged and weren't? And what crimes were the "peaceful protestors" charged with?
You're a lawyer. You know your tweet is disingenuous.
@WajahatAli
Why not call up Hamas and tell them to release the hostages and either surrender or stop putting their own citizenry at risk by hiding in houses and schools and hospitals?
@MairavZ
but the Houthi attack on Tel Aviv would not "escalate a regional war", did not "exact a response hurting Yemen", or "divert attention from the fact that most Yemenis don't want the Houthis attacking Israel".
Strange that you wouldn't mention any of this.
