But as I asked before, what is the model? Is this just another hotel for lawyers billing for activity or is it a game changer in terms of how legal work is done, delivered & paid for? Many professing to be built on some other model than billable hours are still, in fact, activity based (how many hours will it take, what’s our cost, pad that for risk, & add profit)—that’s still not value billing, it’s cost plus with budget risk allocation. True value-based relationships are based on effectiveness (outcomes), efficiency (at or below agreed cost) & experience (customer’s with provider). Now that’s #DeliveredValue and . . .

Outside #LawLand, there are only 2 questions that actually matter in contract review & negotiation: can ops use what purchasing bought; can ops do what sales promised? BTW-that goes for M&A, IP licensing, & all ancillary contracts. After all, all that ancillary “unique” & “special” stuff is really just about revenue

Perhaps, but most contract review & negotiations tools & most LawLander focus on provisions that matter little or only if things go wrong. Focus should be on understanding & accepting commitment, not what happens when they aren’t met. It’s operational contract review that matter-most LawLanders aren’t qualified

Ah yes, THIS TIME, it will be different — doubtful — while Big Four COULD leverage their access to the well spring of corporate operations, they are more likely to simply be another hotel for #LawLanders — focused on doing the wrong things in the wrong ways. Reactive, not proactive, janitorial not preventive, and billing for activity not #DeliveredValue.

Great article with great insights. Problem, however, is prevailing biz model for firms remains billing for activity, not results, efficiency or customer experience. Unless & until in-house buyers demand #DeliveredValue, it’s just falderal but little change.

Rob—thanks for the shout out in this thoughtful, piece. Like you, I doubt most of #LawLand can, or perhaps more important, is willing, to transcend your 1st stage. That’s due primarily to the prevailing biz model—& the lack of escape velocity from it.

BTW — this dynamic is caused by buyers, not sellers. Customers from the same tribe who also believe in lawyer exceptionalism and that answering esoteric interesting questions of law is more important than customer-focused #DeliveredValue. Far past time for customers to vote with their fees!

Trick question—with LawLand’s predominant activity based billing model, not efficiency or results, why would “top” lawlanders EVER work faster? It’s well past time to move to customer focused value billing—embrace #DeliveredValue & become a real “top” legal service provider!
