IMO, JCP does not legally exist & cannot act due to poor drafting of 26th Amendment. To be complete, new JC must have senior-most member of Constitution Bench. But that Bench doesn’t exist - it has to be created by JC! Now govt says this doesn’t matter coz Art 175A(3D) allows 1/3
