We commend Premier Chris Minns for addressing the rise in antisemitic incidents in NSW through proposed reforms, including a criminal offence for inciting racial violence or hatred with a two-year maximum penalty. This is a proportionate response to safeguard Jewish families and communities. However, we caution against expanding these provisions beyond race and ethnicity, as doing so could risk infringing on free speech and religious expression. Including attributes such as ‘faith,’ ‘sexual orientation,’ and ‘gender identity’ might unintentionally criminalise discussions on topics like marriage, gender dysphoria treatment, or theological teachings on salvation and the nature of God. Legislation should protect vulnerable groups without infringing on freedoms essential to democracy. The NSW Law Reform Commission previously advised against broad changes to Section 93Z to avoid suppressing legitimate speech. The Australian Human Rights Commission (AHRC) has once again demonstrated its ideological capture by opposing Queensland’s decision to pause the prescription of puberty blockers and cross- sex hormones for children. The Commission’s stance on this issue raises serious concerns about its commitment to evidence-based healthcare and the protection of vulnerable children. A government-funded human rights body should not be advocating for the continued use of experimental medications on children. Queensland’s decision offers a crucial opportunity to align its healthcare with international best practice. In a recent media release, Sex Discrimination Commissioner Dr. Anna Cody declared “gender-affirming healthcare” to be a “human right” and warned that pausing these medical interventions could potentially harm children’s physical and mental wellbeing. Dr. Cody’s assertions contradict the findings of the Cass Review in the UK, which found that there is no supporting evidence to suggest gender-affirming treatments improve mental health outcomes. The Cass Review also highlighted the significant health risks associated with puberty blockers and the lack of long-term research on their use – a concern that no Australian jurisdiction has yet addressed. We commend the Queensland Government for its decision to pause these harmful treatments and conduct an independent, evidence-based review. We welcome the Queensland Government’s decision to push forward with its own review into the prescription of hormone treatments for minors. The Crisafulli Government’s decisive leadership, including an immediate ban on puberty blockers for minors, stands in stark contrast to the Federal Government’s inadequate and dangerously slow response. Waiting until mid-2026 for a federal inquiry to report its findings is too little, too late, especially when the UK’s extensive Cass Review has already provided overwhelming evidence that prescribing life-altering drugs to children is both negligent and ideologically driven.
